IV. SALIENT PROVISIONS

  • Retains the requirement of registration

  • Maintains the process of application

  • Increases the substantial capital requirement from P25,000.00 to P100,000.00

  • Shortens the validity of the certificate of registration of contractors from 3 years to 2 years

  • Retains the requirement of semi-annual reporting

  • Maintains the grounds and process of cancellation of registration

  • Reiterates the prohibition against LOC based on statutory definition and jurisprudence

  • Expands illicit forms of employment arrangements

    • Contracting out of work to an in-house cooperative​

    • Requiring employees to become members of cooperative

    • Other schemes, practices or arrangement designed to circumvent the workers' right to security of tenure

  • Removes the provision that employment contract is co-terminus with the service agreement

  • Labor-only contracting or subcontracting is PROHIBITED
